We respectfully submit forty-third Annual Report of the 
Department of Public Utilities for the fiscal year ending June 30, 
1966. 



During the fiscal year one appointee served as Chairman 
of the Commission through the designation of the Governor of the 
Commonwealth, to wit: Roy C, Papalia (Republican) of Watertown. 
Other members of the Commission holding office during the year 
were' David M. Brackman (Republican) of Newton, Joseph P. Cleary 
(Democrat) of Cambridge, Lucy M. Carra (Democrat) of Springfield, 
Norman Mason (Democrat) of Taunton, Andrew L. Benson (Democrat) 
of Melrose, and Helen P. Ross (Republican) of Melrose.

Quarterly financial statements an d statistical reports 
were filed with the Department by approximately forty-five trans- 
portation companies, including railroad, street railway and motor 
bus companies.

The above returns were analyzed and checked by the 
(Department for compliance with the rules of the Department and/or 

ithe Uniform Systems of Accounts and were amended, when necessary, 
■after conferences with officers of the reporting utilities or where 

possible by correspondence. 

In addition to the above, there were within the jurisdiction 
pf the Department 531 regular route common carriers, 7248 irregular 
Kroute common carriers, 7096 interstate licensed carriers, 595 contract 
barriers and 92 agricultural carriers actively engaged in the trans- 
portation of property for compensation within the Commonwealth. 

During the fiscal year the Commission and employees authoriz 
and designated by the Commission held 246 formal hearings, and the 
vommission held 49 informal conferences with representatives of the 
various utilities under its jurisdiction.

I AN ACT RELATIVE TO THE OPERATION OP LIOTOR VEHICLES FOR THE 
CARRIAGE OP PASSENGERS FOR HIRE 

The department recommended this amendment to Section 7 

of Chapter 159A of the General Laws for the reason that the present 

law provides for transfer of a certificate of public convenience and 

necessity in the event of the decease, incompetency, bankruptcy or 
corporate reorganization of the holder of a certificate of public 
convenience and necessity, but it does not provide for the possible 
transfer of a charter license to be transferred to an assignee, 
trustee or personal representative under the same conditions and 
with the same qualifications as exist with a certificate of public 
convenience and necessity. THIS RECOMMENDATION WAS PASSED AND SIGNED

The purpose of this recommendation by the Department was 
to prevent a common carrier of passengers for hire licensed by this 
Department operating regular routes within a franchise area from 
weakening the financial structure of said carrier by the incurring 
of certain obligations or of the pledging or mortgaging of any of 
its carrier property without the prior approval of the Department. 

This amendment could prevent a carrier from mortgaging 
its carrier property to secure funds to promote a subsidiary non- 
carrier foreign corporation, which corporation is of no financial 
benefit to its Massachusetts carrier operation and on the contrary 
could result in the depletion of the carrier's assets and lead to 
its insolvency, all to the detrement of the riding public in its

THE GENERAL COURT TO A STUDY AND SUBSEQUENTLY REJECTED ON JUNE 2* 
1966 

III AN ACT FURTHER DEFYING THE POV/ERS OF THE GAS REGULATORY BOARD 
The purpose of this amendment is to clarify the status 

- 

j of the Gas Regulartory Board, created by Chapter 737 of the Acts 
of I960, wherein the Legislature left silent the question of the 
supervising agency over said Board. There has been confusion and 
ambiguity as to the Department's jurisdiction over the Board since 
its creation by the Acts of I960. It appears that the legislative 
intent at the time of the creation of this Board was that said 
Board should be under the control and supervision of this Depart- 
ment although this intent was not spelled out in the language of the 
Bill, Various attempts have been made since I960 to exclude the 
departmental jurisdiction by legislative amendment. Each of these 
bills was defeated during some course of the legislative process. 
It is the opinion of this Department that this Board should not be 
autonomous and should have supervision over budget matters as well 
as the physical structure itself. The Department since the inception 
of this Board has supervised said Board in every aspect and it was 
our opinion that passage of this amendment would clarify the juris- 
dictional question to the satisfaction of all concerned^ THIS BILL 
WAS REFERRED TO THE NEXT ANNUAL SESSION ON MARCH 15 BY THE GENERAL 

court; 

iv • an act to prohibit a gas or electric company from guaranteeing 
the indebtedness of another company without the consent of the 
department. 

Under the present law operating utility companies are not 
permitted to invest in or loan its funds to other companies since 
such investments or loans may jeopardize the ability of the utility 
to provide service to the public. For the same reasons such 



companies should not be permitted to make investments or loans 
indirectly by means of a guarantee of indebtedness, and the 
proposed amendment would prohibit such guarantee. THIS RECOM*

ACTS OP 1966. 

- AN ACT TO PLACE ON THE UTILITY COMPANIES THE BURDEN OP 
PROVING THE REASONABLENESS OP THEIR RATES 

Sections 1, 2, 3 and 4. It is uncertain under the 
existing law, in the case where the Department institutes a 
proceeding with the view to reducing the rates of the utility 
company, whether the company or the Department has the burden of 
proof. Since the evidence on which such a determination will be 
made is primarily in the hands of the company, the Department 
would be hampered in the exercise of its power to effect necessary 
rate reductions, if it could not call upon the companies to prove 
that their rates were reasonable. Moreover, the resources of the 
Department would be spread too thin, in the course of investigat- 
ing the rates of a member of utilities companies, if it was required 
to prepare evidence constituting a prima-facie case whenever it had 
reason to believe that a rate reduction might be appropriate. This 
recommendation merely requires that if the Department has reason to 
institute investigation into the existing rates of any utility com- 
pany, the company will be required to show in the same manner in 
which it has been traditionally required in the case of rate in- 
creases that the rates and charges are reasonable* THIS RECOM-

71 AN ACT TO REQUIRE CONTRACT CARRIERS TO OBTAIN APPROVAL OP 
THE DEPARTMENT TO SERVE MEW SHIPPERS. 

Contract carrier permits are issued "by the Department 

in cases where the carrier proposes a specialized service not 

offered by a common carrier. In order to prevent a contract 

carrier from "becoming, in effect, a common carrier, merely by the 

addition of an unlimited number of customers to his contract, the 

Department recommended this petition making it clear that no new 

customer can be added to the carrier's authorization without prior 

approval of the Department. THIS RECOMMENDATION WAS REJECTED BY 

THE LEGISLATION ON APRIL 2, 1966. 

— AN ACT TO REQUIRE STEAMSHIP COMPANIES TO POST BONDS. 

In recent years the Nantucket Boat Service has been 
operated by a new corporation formed each year in another state. 
Service begins about the first of June and terminates at Labor 
Day. Thereafter the ships travel south leaving no address and 
no person in responsibility. This recommendation would provide 
the Department with some effective means of controlling the opera- 
tion of these carriers and would afford aggrieved passengers some 
redress which is not now available to them. THIS RECOMMENDATION 
WAS REJECTED BY THT. LEGISLATURE ON JUNE 2, 1966. 

VlTT AN ACT RELATIVE TO PROTECTION AT GRaDE CROSSINGS, 

Chapter 886 of the Acts of 1965 amending the original 
law creating the Massachusetts Bay Transportation Authority. The 
third sentence of said Chapter 886 of the Acts of 1965 removed 
from the Department jurisdiction over railroad grade crossings 
whenever said operating railroad had a contract with the MBTA wiibh-

out charging any other agency with the responsibility of the main- 
tenance of safety at these grade crossings. The Department recom- 
mended this legislation to insure safety to the traveling public 
as prescribed for by Section 14-7 of Chapter 160 of the General

During this period there were 1020 formal complaints 
made to the division for assistance relative to telephone 
and telegraph matters which required special research and 
investigation, with detailed written reports on all such 
complaints. Many informal inquiries were also made to 
the Director and personnel of the division. 

' There were three formal hearings held before the 
Commission relative to the telephone matters; 



1. Custom telephone units. 

2. Community Antenna Television Distribution 

3. Hospital Interphone System. 

In June of 1966 the Commission upon its own motion 
instituted an investigation of the practices of the New 
England Telephone and Telegraph Company in service moni- 
toring for quality control, so called, and service train- 
ing and assistance equipment. Formal hearings on this 
matter are now pending before the Commission. 

Also in June of 1966 the New England Conference of 
Public Utilities Commissioners, voted to have the tele- 
phone staff committee conduct an investigation into the 
service monitoring practices conducted by the New England 
Telephone and Telegraph Company. The director of this 
division who is a staff member participated in such 
investigation representing the department. A detailed 
written report of such investigation will be submitted 
to the Department Chairman in each state. 

There were 32 Exchanges in which the extra mileage 
charge made to telephone subscribers was completely 
eliminated .

There were also 19 Boundary Changes which were placed 
in effect to more adequately serve the subscribers request for 
service. In August Of 1965 the Wilmington Exchange was given 
the optional 1-ER service and the establishment of Cross Core 
calling in the Springfield Metropolitan Area exchanges. 

The above changes have resulted in substantial savings 
to the subscribers served by such exchanges on their monthly 
bills, plus giving a better telephone service.

The elimination of 2 party measured service in the 
localities of North Swansea, Seekonk, and Southgate. 

There were many new equipment offerings, some of 
which are, Trimline Telephone, Expansion of Touch Tone 
Service, Community Antenna Television Distribution, Custom 
Telephone Units for Antique Type Telephones, Inward Wide 
Area Telephone Service.

Custom Calling Service has been offered to subscribers 
of the Wellesley Exchange on an Experimental Basis for a 
limited period of time. The features of this service are: 

a. Call Transfer - a feature to permit the transfer of 
all incoming calls to another ' telephone in the 
customer's local calling area, 

b. Call Waiting- a feature which signals a customer 
who is talking on his line, that another call has 
been placed to his line. 

c. Present Call Transfer - a feature whereby telephone 
calls can be transferred by abbreviated dialing to 
any one of eight frequently called telephones 
located in the local calling area. 

d. Speed Calling - a feature which permits a customer 
to place calls to a list of up to eight frequently 
called numbers by abbreviated dialing. 

e. ThreeWay Calling - a feature by which a customer 
can add a third party, located within the local 
calling area, to a call already established. 

During this period there were several personnel changes 
in the Division. Mrs. Judith Traub resigned her position as 
HeEj-d Administrative Clerk in October of 1965, she was replaced 
in November of 1965 by Mrs. Angelina Hebert who terminated her 
services in January of 1966. This position has not been filled 
as of date. In March of 1966 William T. Logan was appointed 
to fill the permanent vacancy of Telephone and Telegraph 
Inspector. 



Commercial Motor Vehicle Division 

During the fiscal year covered by this report a total of 1218 
public hearings were conducted by the Commercial Motor Vehicle 
Division, of which 1183 represented hearings held on new app- 
lications, amendments to existing certificates and permits and 
on transfers of existing operating authorities. Thirty-five 
hearings were held involving requests for approval of stock 
acquisitions. 

A total of 528 complaint hearings were conducted during this 
period ; these included 196 hearings on carriers delinquent in 
filing annual financial reports, (D.P.U. 13773) » and 288 hearings 
for failure to render service as a common or contract carrier 
within the period of time specified by statute. During this 
period 2912 road and cargo checks were made by investigators of 
the Division in all sections of the Commonwealth. Alternate 
members from the Division served on or presided at 22 joint board 
hearings before the Interstate Commerce Commission. 

Chapter 518 of the Pets of 1965 became effective August 30, 1965 
and required adequate coverings on loads of certain dump truck 
commodities. In September of 1965 the Division by letters and 
by personal contacts notified every dump truck owner and operator 
in the Commonwealth of this provision and indicated failure to 
comply would be cause for suspension or revocation of a carrier's 
certificate. There have been no changes in our reciprocal ar- 
rangements with other states. There are presently in effect such 
arrangements with 25 states and the District of Columbia. 

During the period covered by this report V/allace G-. Kittredge 
retired as Director after serving 26 years in that position. 
Paul M. Fitzsimmons was appointed temporary Director upon the 
resignation of Mr. Kittredge. 

The Division conducted an extensive survey of alleged violations 
by both the carriers and shipr>ers involved in dump truck operations. 
Investigations were made and reports written on operations of cer- 
tain armored car carriers and some changes in policy resulted 
(D*P.U. 14977-1). A study is being conducted with the thought 
of revising the Department's cargo insurance requirements in light 
of present day conditions. 

The Director of the Division is serving as the Massachusetts 
member of the Transportation Staff Committee of the New England 
Conference of Public Utilities Commissioners, The principal work 

of this Committee at the present time is devoted to a study of 
the effect of the New Federal law viz: Public Law 89-170 and is 
compiling reports and suggestions tending to promote uniformity 
and cooperation as between states and the Interstate Commerce 
Commission. 

At the close of the fiscal year there were 531 regular route 
common carriers, 7248 irregular route common carriers, 7096

interstate license carriers, 595 contract carriers, and 92 
agricultural carriers actively engaged in the transportation of 
property for hire within the Commonwealth, ' There were also 16 
holders of transportation broke'rs licenses. The Division issued 
97804 distinguishing plates to registered carriers and received 
in fees from all sources a total of $321,956,97

RAILROADS AND STREET RAILWAYS 

During the fiscal year the Division of Railway and Bus 
Utilities made 11,322 inspections of rolling stock, including 
locomotives, passenger and freight cars, 749 inspections of street 
railway cars, and 268 inspections of trackless trolley coaches, 
917 inspections of railroad and street railway "bridges, 671 inspec- 
tions of railroad and street railway stations, 2179 inspections of 
railroad and street railway automatic and interlocking stations, 
53 inspections of Remote Control C.T.C. and interlocking stations 
and 209 automatic train stops. In" addition, switches, derails, 
foot blocking, bridge guards, crossings and crossing sj gns were 
inspected and defective conditions were called to the attention of 
the proper officials of the companies and corrections were made. 

The Division investigated 89 accidents and 77 delays in 
service on railroads, 19 accidents and 4 delays in service on 
street railways. There were 69 complaints relative to railroad 
operations and 8 complaints on street railways investigated and 
adjusted. There were 39 studies and investigations pertaining to 
railroads and 21 on street railways. The Division held 18 public 
hearings pertaining to railroads and 6 on street railways and 
issued 17 orders affecting railroads and 4 effecting street rail- 
ways . 

MOTOR BUS TRANSPORTATION 

At the close of the fiscal year there were 148 persons, 
associations or corporations, including street railway corporations, 
operating within the Commonwealth of Massachusetts for the carriage 
of passengers for hire, as follows;

This represents a total of 94 carriers operating under 
Certificates of Public Convenience and Necessity as Common Carriers 
and 132 operating under Charter Licenses issued by the Department. 

Acting under the provisions of Chapter 482 of the Acts of 
1947, the Division handled 142 applications for Special Service 
Permits and issued 139 such Permits, denying 3. 

For the first time certain school bus operations were placed 
under the supervision of the Department in accordance with the 
provisions of Chapter 537 of the Acts of 1965, which authorized the 
Department to issue School Service Permits for the transportation 
of children to and from school and to summer day camp. This 
legislation enabled bus operators, after obtaining the necessary 
permit from this Department, to transport children to summer day 
camp and to and from school on operations which were not covered 
by regular school bus operations under contract with a city or 
town under municipal tax appropriations. During the course of the 
fiscal year the Department handled 286 applications for School 
Service Permits, denying 4 applications. 



There were 596 Bus Permits issued (including duplicates) 
and 7061 Bus Drivers' Licenses (including duplicates) for which fees 
aggregating $14,514.50 were received. 

The Division made 8,463 inspections of buses, 911 inspections 
of bridges over which buses are operated in regular route operations 
and 27 inspections over routes for new certificates of operation. 
There were 59 complaints relative to buses investigated and adjusted 
and 17 accidents investigated pertaining to bus operations. There 
were 611 drivers examined for bus drivers licenses. The Division 
conducted 70 public hearings pertaining to bus operation and issued 
25 orders relating to bus operation, 13 Certificates of Public 
Convenience and Necessity, 4 new Charter Licenses and 7 temporary 
licenses. There were special studies and investigations made regard- 
ing transportation in various parts of the Commonwealth, and. the 
Department participated in a number of Interstate Commerce Commission 
Joint Board Hearings relating to bus operation. 

During the course of the fiscal year, the Division, as in 
the past, has devoted considerable time and attention to matters 
designed to promote safety in rail and motor bus operations through- 
out the Commonwealth by attending meetings and conferences with 
organizations an'" groups whose primary purpose is the promotion of 
safety. With constant improvements being made in the manufacture an^ 
construction of modern motor buses which are operated over today's 
super highways and turnpikes, it is imperative that the employees of 
the Division keep abreast of these modern day technical improvements

In addition to the filings shown above, the Division received, 
examined and issued formal orders on 210 Petitions seeking a 
waiver of the statutory requirements or of Department rules govern- 
ing the forms of tariffs. 

Informal conferences in the number of 820 v/ere held on rates 
matters with various officials or representatives of common 
carriers and other utilities. 

During this period the Division continued its extensive 
survey as to the status of all common carriers holding authority

with the Department. It was believed, and the investigation to 
this point has justified said "belief, that many of these carriers 
were no longer actually conducting operations and that many of 
the tariffs presently on file with the Division either did not 
actually represent present operations or charges, nor comply 
with the rules and regulations of the Department as to the form 
of tariffs or as to the level of rates contained therein. 

Also, during this period, the Division conducted a "follow-up" 
on approximately 1200 common carriers who were delinquent in the 
filing of their Annual Motor Carrier of Property Reports. This 
"follow up" resulted in the filing of approximately 1150 of these 
delinquent reports along with the collection of &5»750. in 
required filing fees. 

During the year July 1, 1965 to June 50, 1966 the Division 
of Rates and Research collected $29,836.15 in filing fees.

Annual Report of the Division of Investigation of Securities 
for the Fiscal Year Ended June 30, 1966 



The Division of Investigation of Securities, located at 100 Cambridge 
Street, is a Division under the supervision of the Commission super- 
vising and controling the Department of Public Utilities. 

The purpose of the Division is to enforce Chapter 110A of the Genera] 
Laws, as amended, known as the Sale of Securities Ac&. This Qhapter 
was enaated August 26, 1921, for the purpose of controlling the sale 
of securities, to register persons selling the same, and to prevent 
the fraudulent promotion and sale of fraudulent securities. 

All "brokers and salesmen engaged in the business of selling secur- 
ities in this Commonwealth must be registered annually with this 
Division. During the fiscal year ended June 30, 1966, o78 brokers 
and 5,181 salesmen were registered, also 453 transfer registrations 
were issued for salesmen transferring from the employ of one broker 
to another broker. 

The fee for original and renewal registration is $100 in the case 
of a broker and $10 in the case of a salesman; also, a fee of $10 
is required for recording the transfer of a registered salesman from 
the employ of one broker to another broker. The fee for the filing 
of a Notice of Intention to offer for sale is $25 and the fee for 
the filing of a petition requiring the approval of the Commission 
is $10. Based on these fees, the income for the Division for the 
fiscal year amounted to $136,245. 

Applicants for registration as broker or salesman, pursuant to 
Section 10 of the Chapter, were required to file information 
statements signed under oath showing their past occupations, 
criminal records, if any, letters of reference, etc. All applicants 
for registration as broker or salesman were given an oral examina- 
tion in order to demonstrate their qualifications for engaging in 
the securities business. 

Brokers conducting a general security business were required to file 
annual statements showing their financial condition. These state- 
ments are kept in a separate file -and in accordance with Section 12 
of the Chapter are not open to public inspection. 

Section HE of our Sale of Securities Act reads in part as follows s 
"No foreign or domestic corporation shall sell, or offer for sale, 
any of its securities to any of its employees other than those who 
are officers thereof, unless such corporation has received general 
authority in writing from the Commission to make such sale." Pur- 
suant to the provisions of this Section, 15 petitions were submitted 
to this Division, all of which met the requirements of the stat- 
ute and were approved by the Commission.

Section 11 of our Sale of Securities Act reads in part as follows : 
"No person shall sell any security, including periodic payment plan 
certificates, which is to be paid for upon an instalment or partial 
payment plan, unless such plan has first been approved by the 
Commission." Pursuant to the provisions of this Section, 4 petitions 
were submitted to this Division by Mutual Funds offering periodic 
payment plan certificates, all of which met the requirements of the 
statute and were approved by the Commission. 

As required by Section 5 of the Act, a Notice of Intention to offer 
for sale, together with certain other relevant information, must 
first be filed before a security may be offered for alse in this 
Commonwealth. However, certain exemptions to this filing have been 
provided for in Sections 3 and 4 of the Act. During the fiscal year 
529 Notices of Intention were filed representing 545 different securi- 
ty issues. 

b?l}e Division required reports to be filed annually by 360 corpora- 
tions, companies, associations and trusts having their securities 
qualified for sale in this Commonwealth, Of these reports, 148 were 
filed on the calendar year and 212 on a fiscal year basis. These 
reports are examined by the accounting personnel of this Division 
and are retained on file for the use of the public and in some 
instances are the only reports available. 

352 investment companies, or so-called investment trusts, having 
their securities qualified for sale in this Commonwealth, were 
required to file annual reports with this Division. These reports 
are also examined and analyzed by our accounting personnel and are 
open to the public for their inspection. 

Complaints from the general public relative to the activities of 
registered brokers and salesmen and alleged violations of the pro- 
visions of the Sale of Securities Act have been investigated and 
either disposed of to the satisfaction of all patties concerned, 
referred to the Attorney General for further action, or are in the 
process of being investigated by this Division. 

Chapter 843 of the Acts of 1963 authorized the incorporation of 
domestic variable annuity insurance companies and provides for the 
regulation thereof. Section 6 of this Chapter reads as follows s 
"In addition to all provisions of law relating to insurance agents, 
insurance brokers, and insurance advisors, every person engaged with 
the negotiation or- sale of a variable annuity contract, and such 
eontract, shall be subject to the provisions of Chapter 110A" , which 
Chapter is administered by this Division. As a result of this 
legislation, the first variable annuity contract to be "sold to the 
public was approved by the Commission on June 22, 1966,

plans were filed with the Accounting Division and are available as 
a public record. 

During the year members of the Division visited the construction 
site of the Connecticut Yankee Atomic Company, in which company the 
Department has authorized the investment of funds by several Massa- 
chusetts companies. The progress of the construction was reviewed 
and a limited amount of vouchers were examined in order that the 
Department may continue to be informed as to the progress of the 
construction and the status of the investment. 

Municipal lighting plants 

The following is a list of the municipal lighting plants with 
their precentages of earnings which, from returns filed in 1966 for 
the year ended December 31> 1965, appear to have violated the pro- 
visions of the statute requiring such plants to reduce their rates 
when they have earned a profit in excess of the eight per cent

NATURAL GAS 

Held conferences with Tennessee Gas Transmission Company 
personnel ret problems associated with storage of liquid natural 
gas in connection with the company's petition in D.P.U. 14978 for 
authority to construct and operate a liquid natural gas storage plant 
in Hopkinton. Also a set of rules and regulations were drawn up, 
after study, to be appended to the Department's distribution safety 
rules. Periodic sound level studies were conducted at the site. 

Attended conference with Public Safety Department re: use of 
Dresser couplings on gas piping in Massachusetts and witnessed 
demonstration of their use. 

Inspected area in North Reading where Mystic Valley Gas Company 
and Lowell Gas Company have petitioned for authority to extend their 
distribution systems. 

Conducted numerous conferences with Department personnel, gas 
company representatives and representatives of various contractors 
re? observance and enforcement of Chapter 370 of the Acts of 1963

At North Reading, inspected progress of gas main installation 
by Lowell Gas Company in compliance with the Department's order in 
D.P.U. 14787. 

Inspected sites and locations of proposed road crossings and 
the location of houses too close to the pipeline for compliance with 
the Department's rules and regulations per petition of the Algonquin 
Gas Transmission Company for pipeline easements. The Department granted 
the company's petition for easements subject to the condition that the 
company install a continuous rubber barrier sheet for the protection 
of the public. Periodic inspections are made of the installation of 
this barrier to ensure compliance with the conditions of the Depart- 
ment's order. 

At Southbridge and Charlton, inspected proposed road crossings 
to be built over the high pressure pipeline of Tennessee Gas Trans- 
mission Company for compliance with the Department's rules in D.P.U. 
12769. 

At Ashland inspected site and terrain of shopping center built 
over a peat bog in which soil tests indicated the presence of marsh 
gas . 

At Holbrook, held meeting at the request of the Chairman of the 
Board of Selectmen abd personnel from Brockton Gas Company to investi- 
gate gas leak in Holbrook. Also inspected entire area. 

At Athol Gas Company, investigated reasons for high unaccounted 
for gas as reported in the company's annual return. 

Inspected route of Berkshire Gas Transmission Company for 
supplying gas from Pitchburg to Gardner. 

Inspected area where Springfield Gas Company proposed to extend 
their distribution mains into Granby. 

Held meeting with engineer for the city of Leominster concerning 
Prospect Street crossing over the pipeline of the Tennessee Gas Trans- 
mission Company which is an access line to the town pumping station 
and water supply tank. 

Held conference with representatives of the Boston Edison 
8ompany and Algonquin Gas Transmission Company re; encroachment 
of Algonquin's easement on Boston Edison Company's right of way.

WATER COMPANIES 

Held conferences on water supply problems relating to Hill 
Water Company. Conducted water pressure surveys and inspected the 
area. Conferred with the Selectmen, customers and officers of the 
water company and the State Department of Public Health on related 
problems. Inspected water supply sources including measurement 
of mains. 

Examined water supply of East Horthfield Water Company for 
adequacy of supply and held conference with engineers from the 
Department of Public Health re: development of water sources and 
allocation of costs. 

Inspected chlorinator of Westhampton Water Company at the 
request of the Department of Public Health and held conference with 
engineers from the State Department of Public Health. 

Investigated adequacy of supply to subdivision in Cheshire 
by the Cheshire Water Company. 

Investigations, Studies, etc. 

Members of the Division made periodic inspections of progress 
of construction on the Connecticut Yankee Atomic Plant* 

Conferences were held with electric company personnel re: 
loss of service during storms and investigation of complaints from 
customers re: delays in restoring service. 

Members of the Division conducted door to door surveys in 
the town of Townsend re: petitions of the Lowell Gas Company and 
Fitchburg Gas and Electric Light Companies for service in the town. 
The surveys were for the purpose of checking conflicting reports 
submitted by the two companies as to the potential market. 

Conferences were held with counsel and representatives of 
the New England Gas and Electric Association relating to stabiliza- 
tion equipment in Worchester and Cambridge Gas Company systems. 

Conferences were held with representatives of the Sprague 
Meter Company and Olsen Manufacturing Company re: testing and ap- 
proval of their fire stops for use in gas meters in the state of 
Massachusetts. Continued testing of new design fire valves and 
preparation of new rules and regulations issued by the Department 
relating to the installation of these fire stops. Continued study 
of progress of installation Of these valves by Massachusetts gas 
companies (per D.P.U. 14899). 

Continued study of gas meter testing program by gas companies 
in Massachusetts. These are monthly reports submitted by each gas 
company and municipal gas department on a form provided by the 
Department (copy attached).

Considerable time was spent on research into the causes 
of the November Blackout and preparation of a report outlining the 
history and possible measures to be taken to prevent such black- 
outs in the future. 

Chapter 370, Acts of 1963 

Members of the Division held conferences throughout the year 
with gas company personnel and contractors' representatives re: 
excavations in the public ways. Contacted various town Depart- 
ments relative to issuing permits to contractors and others for 
this purpose. Continued survey of damage to gas company facilities 
in the public ways caused by such contractors. 

A total of 460 accidents to gas company facilities were 
reported as occurring during the fiscal year. Of that number 339 
were in the public ways, and 121 on private property. Written 
notice by the contractor or others excavating as required by statute 
was given to the utility involved in 244 instances.

Damage was caused in 112 instances by equipment of the 
municipalities. Accidents occurred during operations in 206 in- 
stances where no notice is required under the law being either on 
private property or caused by municipally owned equipment. 

Many conferences were held with contractors regarding 
safety measures to be taken to avoid damage to underground facili- 
ties of utility companies. 

A monthly statement of damage to their facilities is filed 
by each gas company or municipal gas department, (see attached form) 

Gas Meter Inspection 

During the past fiscal year, 194,415 gas meters were tested 
and inspected as required by statute. Those meters found to be 
registering correctly were sealed and badged as required. 

One hundred sixty-six meters were tested on complaint. 
Of these, one hundred thirty- three wer^ found to be operating 
correctly; thirty- three were found to/operating incorrectly, i.e. 
inaccurate by more than two percent. 

Gas Inspection 

Under the provisions of section 109 s Chapter 164, "the gas 
of every company which supplies more than fifty customers shall be 
inspected at least twice a year and as much oftener as the De- 
partment may determine. The Department may from time to time estab- 
lish a new standard for purity for gas, and after a public hearing 
determine how many grains of sulphur and ammonia per hundred cubic 
feet of gas may be permitted, but not more than thirty grains of 
sulphur per ■ hundred cubic feet and no sulphuretted hydrogen shall 
be allowed."

Gas Inspection - ( c ont . ) 

During the period from July 1, 1964 through June 30', 1965, 
this Division made 156 gas inspections relative to heat content, 
hydrogen sulphide, ammonia and grains of sulphur per cubic foot. 
These inspections showed no violations of the legal standards. 

During this period, two gas meter provers were calibrated, 
one calorimeter thermometer was calibrated and three rotary meters 
were tested. 

Complaints 

A total of 1785 complaints relating to charges, r^tes, 
quality of service, shut-off s and extensions of the various gas, 
electric and water companies was received and investigated. These 
may be broken down as follows: 

Gas 

Billing, 262°, shut-off s, 436; quality, 18; supply, 52; 
miscellaneous, 95; extensions of service, 6. 

Electricity 

Billing, 447; shut-off s, 271; quality, 31; supply, 79; 
miscellaneous, 44; extensions of service, 38.

Fees 

The Division received and accounted for $98,550.00 in fees 
for the testing of meters. 

Accidents 

A total of sixty-six accidents was reported to the Depart- 
ment relating to electricity. Fourteen of these were fatal, and 
were investigated by the Department. 

A total of two hundred ninety-four incidents involving gas 
was reported to the Department. Sixteen of these were fatal and 
were investigated by the Department.

The order of the Department dated December 28, 1923 adopting 
regulations to govern the destruction of records of gas, electric 
and water companies and of municipal lighting plants providing for 
the destruction of customers' ledgers or other records used in 
lieu thereof at the end of six years is herein amended to provide 
for destruction at the end of three years. 

The following vote is, therefore, adopted. 

In the matter of regulations to govern the destruction of 
records of gas, electric and water companies and municipal light- 
ing plants, it is 

VOTED s Item No. 10 - Ledgers be amended by changing from six 
(6) to three (3) years the following; 

(c) Customers' ledgers and other records used in lieu 
thereof - 3 years 

(d) Customers' ledgers at local and branch offices - 3 years. 
The Department FI1TDS notice and opportunity to present views 

on this amendment are unnecessary, impracticable and contrary to 
the public interest under the provisions of chapter 30A, section 3 
of the General Laws, because this is a minor matter and will re- 
present a modification of the present rules making possible certain 
economies to the companies involved. The Department intends to 
have a complete review of its regulations governing the destruction 
of records.

We respectfully submit forty-fourth Annual Report of the 
Department of Public Utilities for the fiscal year ending June 30, 
1967. 

During the fiscal year Roy C. Papalia (Republican) of Watertown 
served as Chairman of the Commission through the designation of the 
Governor of the Commonwealth. Other members of the Commission hold- 
ing office during the year were: David M. Brackman (Republican) of 
Newton, Joseph F. Cleary (Democrat) of Cambridge, Lucy M. Carra 
(Democrat) of Springfield, Norman Mason (Democrat) of Taunton, Andrew 
L. Benson (Democrat) of Melrose, and Helen P. Ross (Republican) of 
Melrose.

Quarterly financial statements and statistical reports were 
filed with the Department by approximately forty-five transportation 
companies, including railroad, street railway and motor bus companies.

The above returns v/ere analyzed and checked "by the 
Department for compliance with the rules of the Department and/or 
the Uniform Systems of Accounts and were amended, when necessary, 
after conferences with officers of the reporting utilities or where 
possible by correspondence. 

In addition to the above, there were within the jurisdiction 
of the Department 530 regular route common carriers, 7103 irregular 
route common carriers, 7422 interstate licensed carriers, 618 contract 
carriers and 92 agricultural carriers actively engaged in the trans- 
portation of property by motor vehicle for compensation within the 
Commonwealth. 

During the fiscal year the Commission and employees authorized 
and designated by the Commission held 224 formal hearings, and the 
Commission held 53 informal conferences with representatives of the 
various utilities under its jurisdiction.

LEGISLATIVE RECOMMENDATIONS 

I AN ACT RELATIVE TO PROTECTION AT GRADE CROSSINGS 

This was a duplicate petition of a late-filed bill, filed by the 
Department of Public Utilities, 1966 General Court, to correct a situ- 
ation brought about by Chapter 886 of the Acts of 1966. Chapter 836 
removed jurisdiction of this department over safety conditions main- 
tained at railroad crossings of railroads under contract with the 
Massachusetts Bay Transportation Authority without placing the juris- 
diction with any agency. The Department was concerned that the safety 
regulations of railroad crossings of the two railroads which are actu- 
ally under contract for service with the Massachusetts Bay Transport- 
ation Authority has been totally removed. THIS RECOMMENDATION BECAME 
HOUSE 98 AND BECAME THE BASIS FOR SENATE ORDER 1114 WHICH IN TURN WAS 
MADE PART OF HOUSE ORDER 5050 AND WAS ULTIMATELY REFERRED TO THE NEXT 
ANNUAL SESSION IN THE SENATE ON OCTOBER 26, 1967. 

II AN ACT RELATIVE TO ACQUISITION OF CAPITAL STOCK OF ANY MOTOR 
CARRIER 

This petition was filed by the Department to clarify the present 
lav/ with regard to the acquisition of stock of a motor carrier. The 
present law precludes acquiring of "more than fifty percent of stock", 
which phrase is ambiguous. The Department felt that this amendment 
to the law would apply to stock transfers where at least fifty percent 
or more of the stock is being transferred. 

This recommendation would further prohibit change in stock 
structure of a motor carrier subject to jurisdiction of this depart- 
ment where control of corporation is affected without approval of the 
Department of Public Utilities. THIS LEGISLATIVE PROPOSAL WAS DOCKETED 
HOUSE BILL 99 AND SIGNED INTO LAW AS CHAPTER 42 OF THE ACTS OF 1967.

III AN ACT RELATIVE TO INTERSTATE CARRIAGE BY MOTOR VEHICLE 

The Department proposed this amendment to the present law so ae 
to provide for revocation of interstate licenses issued by this depart- 
ment as authorized by Section 10 of Chapter 159B where subsequent to 
February 1, 1967 any carrier has for any 12 consecutive month period 
failed to operate over the ways of the Commonwealth or who has failed 
for a similar 12 month period to obtain and display an interstate 
distinguishing plate or other identifying device required by the Depart- 
ment. THIS RECOMMENBATION WAS PASSED AND SIGNED INTO LA'./ AS CHAPTER 
43 OP THE ACTS OP 1967 . 

IV AIT ACT RELATIVE TO ANY INTERSTATE CARRIER BY MOTOR VEHICLE 
This recommendation proposed that no security or securities be 

sold unless intention to sell is filed with and permitted by the 
Department. THIS RECOMMENDATION WAS DOCKETED HOUSE BILL 101 AND 
BECAME THE BASIS POR HOUSE BILL 4706 AND SUBSEQUENTLY PASSED AND 
SIGNED INTO LAW AS CHAPTER 527 OF THE ACTS OP 1967. 

V AN ACT RELATIVE TO FEES POR DRIVERS LICENSES . 

This was a recommendation to provide increases in the fee for the 
issuance of a license to an operator of a motor carrier of passengers 
from one dollar to five dollars in order to help defray the actual 
cost of licensing and examinations. In addition it proposed a new 
charge of two dollars for renewal of said license annually where, 
theretofore, no fee was required. THIS RECOMMENDATION WAS REFERRED 
TO THE NEXT ANNUAL SESSION IN THE HOUSE ON APRIL 12, 1967. 

VI AN ACT RELATIVE TO FEES FOR "OTOR BUS PERMITS. 

This was a recommendation to place a fee of five dollars for 
annual Renewal of a motor bus permit where, presently, no charge is 
made. The initial permit for a motor bus would remain at a $10.00

figure. Again, this was the Department's attempt to make its fees 
more realistic in order to help defray the actual cost involved. 
THIS RECOMMENDATION WAS DOCKETED HOUSE BILL 103 AND REJECTED IN THE 
HOUSE ON MAY 3, 1967. 

VII AN ACT TO PLACE ON THE UTILITY COMPANIES THE BURDEN OP PROVING 
THE REASONABLENESS OP THEIR RATES. 

The Department felt that it is uncertain under existing lav/, in a 
case where the department institutes a proceeding with a view to re- 
ducing the rates of a utility company, whether the company or the 
department has the "burden of proof therein. Since the evidence on 
which such a determination would be made is primarily in the hands of 
the company, the department would be hampered in the exercise of its 
power to effect necessary rate reductions, if it could not call upon 
the companies to prove that their rates were reasonable. Moreover, 
the resources of the Department would be spread too thin, in the 
course of investigating the rates of a number of utility companies, 
where the Department was required to prepare evidence constituting a 
prima facie case whenever it had reason to believe that a rate reduc- 
tion might be appropriate. This proposed legislation would merely 
require that if the Department has reason to institute investigation 
into the existing rates of any utility company, the company would be 
required to show that its existing rates were in fact reasonable.

VIII AN ACT TO REQUIRE STEAMSHIP COMPANIES TO POST BONDS 

In recent years the Nantaske b Boat Service has been operated by

a new corporation formed each year in another state. Service begins 
about the first of June and terminates at Labor Day. Thereafter the 
ships travel south leaving no address and no person responsible. This 
proposal would provide the Department with some effective means of 
controlling the operation of these carriers and afford aggrieved pass- 
engers some redress which is not now available to them. THIS RECOMMEND- 
ATION WAS DOCKETED HOUSE 105 AND WAS REFERRED TO THE NEXT ANNUAL 
SESSION IN THE HOUSE ON FEBRUARY 15, 1967. 

IX AN ACT REQUIRING THE DEPARTMENT OF PUBLIC UTILITIES TO FURNISH 
LISTS OF QUALIFIED STOCKS OR SECURITIES FOR SALE. 

It was the opinion of the Commission that public convenience and 

necessity require that the department establish and maintain a current 

list of stocks or securities qualified for sale under Chapter 110A 

of the General Laws and containing weekly supplements to such lists, 

including any insertions or deletions thereof, in order that this 

agency safeguard the public from misleading representation. THIS 

RECOMMENDATION WAS DOCKETED HOUSE BILL 106 AND REFERRED TO THE NEXT 

ANNUAL SESSION IN THE HOUSE ON MARCH 2, 1967. 

X AN ACT FURTHER DEFINING THE POWERS OF THE GAS REGULATORY BOARD 
The purpose of this proposal was to clarify the status of the 

gas regulatory board, created by Chapter 737 of the Acts of I960, 
wherein the legislature left silent the question of the supervising 
agency over said board. There has been confusion and ambiguity as to 
the department's jurisdiction over said board since its creation by 
said Act. It appears that the legislative intent at the time of the 
creation of this board was that said board should be under the control 
and supervision of this department although this intent was not spelled 
in the language of the bill. Various attempts have been made since 
I960 to exclude the department's jurisdiction by legislative amend-

ment. Each of these bills was defeated during some course of the 
legislative process. It is the opinion of this Department that this 
board should not be autonomous and that the Commission should have 
supervision over the budget matters as well as the physical structure 
of the board itself. The Department, since the inception of this 
board has supervised said board in every aspect and it is its opinion 
that passage of this amendment would clarify the jurisdictional quest- 
ion to the satisfaction of all concerned. THIS LEGISLATION WAS DOCKETED 
HOUSE BILL 107 AND REFERRED TO THE NEXT ANNUAL SESSION IN THE HOUSE 
ON MARCH 2, 1967. 

XI AN ACT TO REQUIRE CONTRACT CARRIERS TO OBTAIN APPROVAL OF THE 
DEPARTMENT TO SERVE NEW SHIPPERS 

Contract carrier permits are issued by this Department in cases 
v/here the carrier proposed a specialized service not offered by common 
carriers. In order to prevent a contract carrier from becoming, in 
effect, a common carrier, merely by the addition of an unlimited 
number of customers, the Department proposed this amendment in order 
to make clear that no new customer can be added to the carrier's 
authorization without prior approval of the Department. THIS RECOMA 
MENDATION WAS DOCKETED HOUSE BILL 108 AND WAS REFERRED TO THE NEXT 
ANNUAL SESSION BY THE HOUSE ON APRIL 6, 1967. 

SPECIAL INVES TIGATIONS 

During the course of the fiscal year covered by this report the 

services and facilities of the Division of Railv/ay and Bus Utilities 

of the Department were utilized to the fullest in investigation and 

report on three of the most serious accidents involving loss of life 

and personal injuries in the recent history of transportation within 

the Commonwealth. 

On December 28, 1966 a Buddliner train of the Boston and Maine

Corporation crashed into an oil-carrying truck which had become 
stalled on the railroad tracks at Second Street in the City of Everett 
during one of the most severe winter storms of the year. This accident 
resulted in the deaths of thirteen persons. 

On February 20, 1967 an accident occurred at the Sixth Street 
grade crossing in the City of Chelsea involving a Boston and Maine 
Buddliner and an automobile containing five persons. Two were fatally 
injured and the other three seriously injured. 

On March 7, 1967 an elevated train of the Massachusetts Bay Trans- 
portation Authority crashed into the rear end of another elevated 
train which had stopped at City Square Station in Charlestown to dis- 
charge and pick up passengers. This accident also occurred during a 
very severe winter storm and although there were no fatalities a total 
of 430 persons claimed personal injuries. 

These three accidents were the most serious ones in the recent 
history of transportation within the Commonwealth and the inspectors 
of the Railway and Bus Division spent many hours of labor under trying 
conditions seeking to determine the cause of the accidents. As a 
result of the investigations numerous recommendations have been 
advanced which would help in averting a recurrence of accidents of 
this type and these recommendations are now under consideration for 
adoption by the various agencies concerned with the safety of the 
traveling public . 

Also during the course of the fiscal year the services and facili- 
ties of the Department were utilized in an investigation ordered by 
the Department upon its ov/n motion into the regulations, equipment 
and practices of the New England Telephone and Telegraph Company in 
the so-called "morn.torj rig" of telephone nails of its subscribers, and

"b3 r order issued under date of January 25, 1967, required that certain 
changes in the regulations and practices of the company be put into . 
effect governing the so-called "monitoring" of telephone calls. 

The telephone company was also ordered to make a continuing study 
of the entire subject matter and to report to this Department the 
results of it's study together with any recommendations it may have 
relative to the subject. At the time of the preparation of this 
report the company had not filed its report and the Department's 
investigation is being continued pending the receipt of this report. 



LITIGATION 

MUNICIPAL GAS AND ELECTRIC 
LIGHT DEPARTMENT OF THE 
TOWN OF MIDDLEBORO 
vs 

DEPARTMENT OF PUBLIC UTILITIES 

Under date of September 6, 1966, the Municipal Gas and Electric 
Light Department of the Town of Middleboro filed with the Department 
a new schedule of rates and charges applying to residential and com- 
mercial use in the Town of Lakeville, to become effective October 1, 
1966. Notice of the proposed rates was given to the Town of Lakeville 
and on August 30, 1966 the Board of Selectmen of that town filed an 
objection to the proposed schedules and requested the Department to 
investigate the propriety of the rates and charges. 

On September 2B, 1966, the Department issued an order suspending 
the operation and use of the proposed rates until August 1, 1967, 
unless otherwise ordered by the Department. The Board of Gas and 
Electric Commissioners of the Town of Middleboro, under date of 
October 7, 1966, filed a Petition for Appeal with the Supreme Judi-

cial Court asking that the order of the Department suspending the 
schedule of rates be set aside on the grounds that the Department 

did not have the authority or jurisdiction to suspend the schedule 
and that the Department's order was contrary to statutory provisions 
of law relating to the establishment of rates and charges by a munici- 
pal lighting board. 

On October 14-, 1966, the Petitioners filed a motion requesting 
the court to grant a stay of the Department's order, and under date 
of October 31, 1966 a single justice of the court issued an Interlocu- 
tory Decree staying the Department's order upon the condition that the 
Petitioner file with the court a bond in the sum of $20,000 to guaran- 
tee the payment of refunds to customers of any sums which may be due 
them after a final determination of the proper rates and charges. 

On August 16, 1967 the Board of Selectmen of the Town of Lakeville 
filed a motion for leave to intervene as a party of interest in the 
proceedings, and on September 13, 1967 a single justice of the court 
issued an Interlocutory Decree allowing the motion. 

On September 12, 1967, the Department issued its order in the 
proceedings in D.P.U. 15350 in which it disallowed the new schedule 
of rates and charges filed by the Municipal Gas and Electric Depart- 
ment of the Town, of Middleboro. 

At the time of the preparation of this report the matter is still 
pending before the court.

TOWN OP PRAMINGHAM 
vs 

DEPARTMENT OP PUBLIC UTILITIES 



Following numerous public hearings and consideration, the - 
Department on .March 29, 1967 issued Order D.P.U. 15192 approving the 
construction, maintenance and use of a line for the transmission of 
electricity by Boston Edison Company on certain lands in the Towns of 
Medway, Sherborn, Pramingham, V/ayland and Sudbury and exempting the 
land find structures from the zoning by-laws of said municipalities. 

As a result of the issuance of the order, the Town of Pramingham, 
under date of April 17, 1967, filed a Petition for Appeal with the 
Supreme Judicial Court requesting that the order of the Department be 
set aside on the grounds that the order was not warranted as a matter 
of lav/ and was not supported by adequate findings. It further request 
ed that the matter be remanded to the Department of Public Utilities 
with appropriate instructions as to further action in the matter. 

On April 25, 1967, the Boston Edison Company filed a motion for 
Leave to Intervene in the proceedings and the motion was allowed on 
May 3, 1967 by a single justice of the court. 

Under date of May 26, 1967, Boston Edison Company as respondent 
filed its answer to the Petition for Appeal and requested the court 
to issue a decree affirming the decision and order of the Department 
of Public Utilities. 

The Town of Sherborn, under date of August 8, 1967, filed a 
Motion for Leave to Intervene as an interested party, but on August 
24, 1967 a single justice of the court dismissed the petition without 
prejudice to the right of the town to present a similar petition after 
the case has been referred to the full bench of the court.

FURNITURE AND PI MO 
MOVERS ASSOCIATION 

vs 

DEPARTMENT OF PUBLIC UTILITIES 

The Furniture and Piano Movers Association, on March 11, 1966, 
filed with the Department new schedules of rates and charges stated 
in M.D.P.U. No. 11 to become effective on April 25, 1966, and the 
Department issued an order suspending the operation and use of the 
proposed rates until February 25, 1967 pending an investigation as to 
the propriety of the rates. The Association is an organization of 
approximately 300 carriers which have places of business throughout 
the Commonwealth and acts as a publishing agent for these carrier 
members under powers of attorney filed with the Department. 

Under date of February 23, 1967, the Department issued Order 
D.P.U. 15209 which required the filing of a new tariff which would 
contain the new rates as proposed but which also required certain 
changes in its rules and regulations of the Association whioh are 
a part of the tariff. The Association objected to the proposed changes 
in its rules and regulations and filed a Petition for Appeal with "the 
Supreme Judicial Court requesting that the order of the Department be 
annulled and set aside. 

Under date of April 24, 1967, a single justice of the court 
issued an Interlocutory Decree staying the order of the Department 
until further order of the court. 

This matter is still pending before the court.

OXFCRD TRANSPORTATION SERVICE

DEPARTMENT OP PUBLIC UTILITIES 



Under date of October 17, 1966, the Department denied the 
application of Ernest P. Robillard of 5 Clark Street, Webster, 
Massachusetts, doing business as Oxford Transportation Service, for 
a School Service Permit under the provisions of Chapter 537 of the 
Acts of 1965, to operate motor vehicles for the carriage of pass- 
engers for hire for the purpose of transporting children from points 
in Oxford and Webster to four parochial schools, all located within 
the Town of Webster, during the 1966-1967 school term. 

As a result of this action by the Department Ernest P. 
Robillard filed a Petition for Appeal with the Supreme Judicial 
Court praying that the order of the Department be set aside on th. 
ground that Chapter 537 of the Acts of 1965 is iiiapplicable insofar 
as it affects the transportation of children to private schools and 
that it is unconstitutional because it discriminates against private 
schools in contracting for school bus transportation. 

At the preparation of this report the matter is still before 
the court.

DEPARTMENT OF PUBLIC UTILITIES 
The Department, under date of March 29, 1967 and following 
public hearing and consideration, issued Order D.P.U. 15127 in which 
it ordered the New York, New Haven and Hartford Railroad Company 
(Richard Joyce Smith, William J. Kirk, Trustees) to cause the install- 
ation of automatic flashing light signals and pedestrian bell to 
serve as the protection at the crossing at the same level of Woodward 
Street with trackage of the Attleboro Branch of the railroad in the 
Town of Norton in substitution for the existing automatic bell at 
said crossing. The order further stipulated that the work be com- 
pleted in a manner satisfactory to the Department not later than 
September 30, 1967. 

Under date of May 4, l c .;67, the New York, New Haven and Hartford 
Railroad Company filed a Petition for Appeal in the Supreme Judicial 
Court requesting that the Department's order be set aside on the 
ground that the Department had no jurisdiction to issue such an order 
under the provisions of Section 147 of Chapter 160 of the General 
Laws, as amended. The Petitioner further contended that if the 
Department did have jurisdiction in the matter it had failed to make 
an apportionment of the cost of installing, maintaining and operating 
the protection as required by said Section 147 of Chapter 160 of the 
General Laws, as amended. 

This matter is still pending before the court at the preparation 
of this report.

RAILROADS AND STREET RAILWAYS 

During the fiscdl year the Division of Railway and Bus Utilities 
made 1300 inspections of rolling stock, including passenger and freight 
cars, 275 inspections of street railway cars, and 160 inspections of 
trackless trolley coaches, 927 inspections of railroad and street rail- 
way bridges, 325 inspections of railroad and street railway stations, 
2201 inspections of railroad and street railway automatic and inter- 
locking signals, 62 inspections of Remote Control C.T.C. and inter- 
locking stations and 229 automatic train stops % In addition, switches % 
derails, foot blocking, bridge guards, crossings and crossing signs 
were inspected and defective conditions were called to the attention 
of the proper officials of the companies and corrections were made, 

The Division investigated 65 accidents and 81 delays in service 
on railroads, 34 accidents and 13 delays in service on street rail- 
ways. There were 63 complaints relative to railroad operations and 
14 complaints on street railways investigated and adjusted. There 
v/ere 35 studies and investigations pertaining to railroads and 19 on 
street railways. 

MOTOR BUS TRANSPORTATION 

At the close of the fiscal year there were 174 persons, associa- 
tions or corporations, including street railway corporations, opera- 
ting within the Commonwealth of Massachusetts for the carriage pf 
passengers for hire by motor vehicle, as follows:

regular carriers operating under school service permits issued by the 
Department . 

Acting under the provisions of Chapter 482 of the Acts of 1947, 
the Division handled 160 applications for Special Service Permits, and 
issued 155 such permits and denied 5. 

Since 1965 certain school bus operations were placed under the 
supervision of the Department in accordance with the provisions of 
Chapter 537 of the Acts of 1965, which authorized the Department to 
issue School Service Permits for the transportation of children to 
and from school and to summer day camp. This legislation enabled 
bus Operators, after obtaining the necessary permit from this 
Department, to transport children to summer day camp and to and from 
school on operations which were not covered by regular school bus 
operations under contract with a City or Town under municipal tax 
appropriations. During the course of the fiscal year the Department 
handled 250 applications for School Service Permits, denying 13 such 
applications . 

There were 780 Bus Permits issued (including duplicates) and 
7834 Bus Drivers' Licenses ( including duplicates) for which fees 
aggregating $13,219.50 were received. 

The Division made 13,061 inspections of buses, 802 inspections 
of bridges over which buses are operated in regular route operations 
and 17 inspections over routes for new certificates of operation. 
There were 67 complaints relative to buses investigated and adjusted 
and 16 accidents investigated pertaining to bus operations. There 
were 1202 drivers examined for bus drivers licenses.

lines of the railroads operating within the Commonwealth, which con-

of the track, ties ; and road bed, 1147 grade orossings, the condition 
and location of crossing warning signs ( s. 140, c. 160; s. 142, ©, 
160) and of the crossing surface (s. 103, c. 160) and 695 railroad 
"bridges . 



Although no unsafe conditions were found,, several instances of 
undesirable conditions at some locations made it imperative that 
immediate corrections be effected. All other noted defects were dis- 
cussed on the ground with comparable, responsible railroad personnel, 
and definite maintenance programming established.

Conferences were held with the Federal Power Commission staff 
engaged in compliance audits in the State during the year covering 
the' Western Massachusetts Electric Company and the Boston Edison 
Company and the adjustments proposed by the Federr.l Power Commission 
were not objected to by the Department. 

The Chief Accountant represented the Department in the prescrip- 
tion of depreciation rates by the Federal Communications Commission 
for the II ew England Telephone and Telegraph Company. The rates set 
for the next three years were agreed upon rnd will reflect the anti- 
cipated modernizing of much of the jompany 1 s older equipment in the 
State* 

The Division also provided the Department with information which 
resulted in the Department's decision to conduct an investigation 
into some questionable policies and practices in relation to property 
on customers' premises. The Chief Accountant testified for the Depart 
ment and recommended the exclusion from the property accounts and the 
prohibition of the capitalization and inclusion in the rate base of 
appliances, equipment and certain wiring on customers' ixremises which 
is the property of the utilities and which is rented, leased, loaned 
or furnished by the utility in its operations. Hearings on this mat- 
ter have not been concluded 5 therefore, the matter is still pending.

The above changes have resulted in substantial ' savings to the 
subscribers served by such exchanges on their monthly bills, plus 
giving a better telephone service. 

There were many new equipment offerings and tariff changes, the 
more important of which are; Elimination of restrictions on jack 
equipment (these would be related to portable telephones in a home); 
the offering of "Bay State Service" (this is an experimental offering 
in various exchanges whereby a subscriber can call anywhere within the 
Commonwealth for a given rate during evening and week end hours) ; 
"Circle Calling" (this is an experimental offering in various exchanges 
whereby for a given amount a subscriber can call anytime within a 20 
mile radius of a given exchange); a reduction in theminimum hours 
from 15 to 10 for "Measured Watts" (this is wide area telephone ser- 
vice, viz: anywhere in the Commonwealth for ^. given charge for a mini- 
mum of 10 hours per month) ; the inauguration of the Vertical & Hori- 
zontal coordinate system of determing the inter exchange rate distances 
(this is a more accurate method of measuring mileage distances 
between telephone exchanges); touch tone residence package service in 
the Dedham exchange (this is an experimental offering when one sub- 
scriber takes 3 or more telephones, the combined package arrives at a 
lower rate then if taken under separate charges); the elimination of 
all season service charges; a reduction in the non-recurring charges 
for colored telephones; a reduction in the message toll telephone 
service for intra-state, day, station-to-station messages; the offer- 
ing of unlimited metropolitan service to the exchanges of Peabody, 
Concord & Billerica (this optional service offering allows all sub- 
scribers in these exchanges to call into all of the metropolitan 
Boston exchanges without any toll charges.)

Luring the past fiscal year, 178,980 gas meters were tested and 
inspected as required by statute, These meters found to be register- 
ing correctly were scaled and badgod as required. 

Two hundred nineteen gas meters ?;ere tested on complaint; one 
hundred eighty of these were found to be operating correctly; thirty- 
nine were found to be operating incorrectly, i.e., inaccurate by more 
than two per cent .

Gas Inspectio n 

Under the provisions of section 109, Chapter 164, "the gas of 
every company which supplies more than fifty customers shall be in- 
spected at least twice a year and as much oftener as the department 
may determine. The department may £rom time to time establish a new 
standard for purity of gas, and after a public hearing determine how 
many grains of sulphur and ammonia per hundred cubic feet of gas may 
be permitted, but not more than thirty grains of sulpher per hundred 
cubic feet and no sulphuretted hydrogen shall be allowed". 

During the period from July 1, 1966 through June 30, 1967, this 
Division made 123 gas inspections relative to heat content and odorant. 
These inspections showed no violations of th^ legal standards. 

During this period one rotary meter was tested. 

Complaints 

A total of 1976 complaints relating to charges, rates, quality of 
service, shut offs and extensions of the various gas, electric and 
water companies was received and investigated. These may be broken

CORIERCIAL MOTOR VEHICLE DIVISION 



During the fiscal year covered by this report a total of 959 
public hearings were conducted by the Commercial Motor Vehicle Divi- 
sion, of which 554 represented hearings held on new applications or 
amendments to existing certificates and permits. 405 hearings were 
held involving requests for approval of stock acquisitions and trans- 
fers of existing operating authorities* 

A total of 1054 complaint hearings were conducted during this 
period; these included 116 hearings on carriers delinqu.©nt in filing 
annual financial reports, (D.P.U. 13773)? and 916 hearings for fail- 
ure to render service as a common or contract carrier \/ithin the 
period of time specified by statute. During this period 2912 road 
and cargo checks were made by investigators of the Division in vaa?iou 
sections of the Commonwealth. Alternate members from the Division 
served on or presided at 18 joint board hearings before the Inter- 
state Commerce Commission. 

A total of 282 irregular route common carrier certificates, 
23 contract carrier permits and 326 interstate licenses were issued

from July 1, 1966 to June 30, 1967. The Division processed 14 formal 
court cases and submitted written reports on 205 formal investigations 

During this same period after individual public hearings the 
Division revoked the irregular route common carrier certificates of 
427 carriers. This action followed evidence that such carriers had 
either failed to render service for a period in excess of ninety (90) 
consecutive days or had failed to file annual financial reports as 
required by Department order. 

In nearly all cases the carrier failed to appear at the scheduled 
hearings and neglected after notice to supply the Department with any 
valid reason for non-appearance. 

Action is presently being talc en by the Department to review and 
set for hearing the interstate licenses of over five hundred (500) 
interstate carriers believed to be inactive. Under Chapter 43 of 
the Acts of 1967 if it is found that such carriers have failed to 
render service in Massachusetts for a period of one (l) year sub- 
licenses are to be revoked after hearing. Failure to obtain and 
display carrier plates for the current year is the determining factor 
in setting the matter for investigation and public hearing. 

The Division continued in effect reciprocal arrangements with 
25 other states end with the District of Columbia. 

Extensive and prolonged studies have been made as to the best 
method of adapting our procedures and application forms to accord with 
the requirements of the recently enacted Public Lav; 39-170 under the 
so called uniform standards section. In this respect meetings have 
been held not only with the Division Staff but with the staff members 
of other New England States and members of the motor carrier industry 
in the New England 'area. The Director of this Division continues to

serve as the Massachusetts member of the Transportation Staff Commit- 
tee of the New England Conference of Public Utilities Commissioners. 

An employee of this Division during this period served as an 
active member of the Massachusetts Highv/ay La r s Study Commission 
attending all meetings and making those recommendations which in his 
opinion would be beneficial or which would require additional legis- 
lative clarification. 

In the ear ]y months of 1967 the Division Personnel worked with the 
Attorney General !s Office in the preparation and prosecution of cases 
involving certain dump truck operations on public roads and at the 
Logan International Airport. The activities are still continuing 
pending final court disposition. 

Extended investigations and studies are being conducted on the 
problems of waste material disposal in the Commonwealth and of the 
most practical method of coping with the problem Tiy means of motor 
vehicle transportation. 

At the close of the fiscal year there were 530 regular route 
common carriers, 7103 irregular route common carriers, 7422 inter- 
state carriers, 618 contract carriers, and 92 agricultural carriers 
actively engaged in the transportation of property for hire within 
the Commonwealth. There were also 16 holders of transportation 
brokers licenses. The Division issued 103,058 distinguishing plates 
to registered carriers and received in fees from all sources a total 
of $331,992.42.

In addition to the filings shown above the Division received, 
examined and issued formal orders on 240 petitions seeking a waiver 
of the statutory filing requirements or of Department rules governing 
the form of tariffs. 

A survey showed that approximately 700 carriers had not filed 
the Annual Motor Carrier of Property Reports for the year ending 
December 31? 1966 which were required to be filed on or before April 
30, 1967. Working in c :.i junction with the Commercial Motor Vehicle 
Division, an immediate check v/as made with the result that all but 
approximately 111 carriers have now filed said reports. With respect 
to the 111 delinquents proper steps are now being taken to penalize 
them for failing to comply with a Department order.

During this same period, the Division continued its survey of 
Common Carrier Tariff filings with respect to the compliance of the 
tariffs with the Rules and Regulations of the Department. As a 
result approximately 200 carriers have been checked and the tariff 
filings of certain ones corrected so that they now meet the require- 
ments as set by the Department. 

Also during this period, approximately 750 informal conferences 
■/ere held on rate matters with various officials or representatives 
of common carriers arid other utilities. Also at this time the Divi- 
sion investigated numerous rate complaints, "brought by either the 
utility itself or a shipper or customer of the utility or carrier. 

During the year the Division collected fees for the filing of 
certain documents in the amount of $29 » 131. 65 

DIVISION OF INVESTIGATION OF SECURITIES 
The Division of Investigation of Securities is a Division unde: 
the supervision of the Commission supervising and controlling the 
Department of Public Utilities. 

The purpose of the Division is to enforce Chapter 110A of the 
General Laws, as amended, known as the Sale of Securities Act. This 
Chapter was enacted August 26, 1921, for the purpose of controlling 
the sale of securities, to register persons selling the same, and to 
prevent the fraudulent promotion and sale of fraudulent securities. 

All brokers and salesmen engaged in the business of selling 
securities in this Commonwealth must be registered annually with the 
Division. During the fiscal year ended June 30, 1967, 718 brokers 
and 5,718 salesmen were registered, and 411 transfer registrations 
were issued for salesmen transferring from the employ of one broker 
to another broker.

The fee for original and renewal registration is $100 in the 
case of a broker and m>10 in the case of a salesman; a fee of $10 is 
required for recording the transfer of a registered salesman from the 
employ of one broker to another broker. The fee for the filing of a 
Notice of Intention to offer for sale is $25 and the fee for the 
filing of a petition requiring the approval of the Commission is $10, 
Based on these fees, the income for the Division for the fiscal year 
amounted to $145>510. 

Applicants for registration as broker or salesman, pursuant to 
Section 10 of the Chapter, were required to file information state- 
ments signed under oath showing their past occupations, criminal 
records, if any, letters of reference, etc. All applicants for reg- 
istration as broker or salesman were given an oral examination in 
order to demonstrate their qualifications for engaging in the securi- 
ties business. 

Brokers conducting a general security business were required to 
file annual statements showing their financial condition. These 
statements are kept in a separate file and in accordance with Section 
12 of the Chapter are not open to public inspection. 

Section HE of our Sale of Securities Act reads in part as 
follows: "No foreign or domestic corporation shall sell, or offer 
for sale, any of its securities to any of its employees other than 
those who are officers thereof, unless such corporation has received 
general authority in writing from the Commission to make such sale". 
Pursuant to the provisions of this section, 18 petitions were sub- 
mitted to this Division, all of which met the requirements of the 
statute and were approved by the Commission. 

Section 11 of our Sale of Securities Act reads in part as

follows: "No person shall sell any security, including periodic pay- 
ment plan certificates, which is to be paid for upon instalment or 
partial payment plan, unless such plan has first been approved by the 
Commission". Pursuant to the provisions of this section, 4 petitions 
were submitted to this Division by mutual funds offering periodic 
payment plan certificates, all of which met the requirements of the 
statute and were approved by the Commission. 

As required by Section 5 of the Act, a Notice of Intention to 
offer for sale, together with certain other relevant information, 
must first be filed before a security may be offered for sale in this 
Commonwealth. However, certain exemptions to this filing have been 
provided for in Sections 3 and 4 of the Act. During the fiscal year 
465 Notices of Intention were filed representing 603 different securi- 
ty issues. 

The Division required reports to be filed annually by 411 cor- 
porations, companies, associations and trusts having their securities 
qualified for sale in this Commonwealth. Of these reports, 168 were 
filed on the calendar year and 243 on a fiscal year basis. These 
reports are examined by the accounting personnel of this Division 
and are retained on file for the use of the public and in some instan~ 
ces are the only reports available . 

405 investment companies, or so-called investment trusts, having 
their securities qualified for sale in this Commonwealth, were required 
to file annual reports with this Division. These reports are also 
examined and analyzed by our accounting personnel and are open to the 
public for their inspection. 

Complaints from the general public relative to the activities 
of registered brokers and salesmen and alleged violations of the

provisions of the Sale of Securities Act have been investigated and 
either disposed to the satisfaction of all parties concerned, re- 
ferred to the Attorney General for further action, or are in the 
process of being investigated by this Division.
